The purpose of the information published is to allow interested parties to know, before initiating or formalising any transaction, the essential characteristics of the property, the advertised price and the main expenses, taxes, fees and economic items that may arise, where applicable, from the purchase, sale or rental, so that the consumer is aware at all times of the total cost of the investment.<\/p>\n

Applicable regulations<\/h2>\n

  • Royal Legislative Decree 1\/2007, of 16 November: <\/strong>approving the recast text of the General Law for the Defence of Consumers and Users and other complementary laws. This regulation requires that information addressed to consumers be clear, understandable and sufficient, including the total price, taxes, fees and, where applicable, additional expenses or the manner in which these are determined. <\/li>\n
  • Law 12\/2023, of 24 May, on the right to housing: <\/strong>particularly with regard to the information required in residential rental transactions, stressed residential market areas, large property holders, and price limitations or references where legally applicable.<\/li>\n
  • Law 29\/1994, of 24 November, on Urban Leases: <\/strong>with regard to deposits, guarantees, residential leases and other conditions applicable to rental agreements.<\/li>\n
  • Law 10\/2025, of 26 December, regulating customer service:<\/strong> insofar as applicable to the quality, clarity and attention given to consumers and users in the provision of services, as well as to clear, complete and sufficient information in advertising and commercial communications.<\/li>\n<\/ul>\n

    Likewise, any other applicable national, regional or sector-specific regulation governing real estate advertising, purchase and sale, rental, pre-contractual information, consumer and user protection, taxation, and land registry, cadastral, planning, notarial or administrative documentation relevant to each transaction shall apply.<\/p>\n

    Advertised price and expenses not include<\/h2>\n

    Unless expressly stated otherwise in the specific listing, the price published corresponds to the advertised sale or rental price of the property, and does not include any taxes, expenses, professional fees or other economic items that may legally or contractually correspond to each of the parties.<\/p>\n

    In sale and purchase transactions in Cantabria, acquiring a property may involve, among others, the following expenses for the buyer:<\/p>\n

    • Taxes applicable to the transfer, such as the Transfer Tax (ITP), VAT or Stamp Duty (AJD), depending on the type of property, whether new-build or resale.<\/li>\n

      \nTransfer Tax (ITP) (resale homes):

      \n\u2013 Primary residence: 7 % on the first \u20ac300,000 and 9 % on the excess.
      \n\u2013 Reduced rate of 4 % for certain cases (such as buyers under 40, large or single-parent families, and certain people with disabilities, provided the legal requirements are met).
      \n\u2013 Rate of 3 % for certain cases of disability equal to or greater than 65 %.
