In compliance with current regulations on the protection of consumers and users, real estate advertising, price transparency and pre-contractual information, ACTIVA NORTE GESTIÓN INMOBILIARIA hereby informs that the listings published on this website are for informational purposes only and are prepared in accordance with the principles of truthfulness, clarity, transparency, sufficiency of information and the avoidance of misleading content.
The purpose of the published information is to enable interested parties to know, before initiating or formalising any transaction, the essential characteristics of the property, the advertised price, and the main costs, taxes, fees and economic items that may arise, where applicable, from the purchase or lease, so that the consumer is aware at all times of the total cost of the investment.
2. Applicable regulations
The information contained in the listings published by Activa Norte Gestión Inmobiliaria complies, among others, with the following regulations:
· Royal Legislative Decree 1/2007, of 16 November: which approves the recast text of the General Law for the Defence of Consumers and Users and other complementary laws. This regulation requires that information addressed to consumers be clear, comprehensible and sufficient, including the total price, taxes, fees and, where applicable, additional costs or how these are determined.
· Law 12/2023, of 24 May, on the right to housing: particularly regarding the information required in residential lease transactions, stressed residential market areas, large landlords, and price limitations or references where legally applicable.
· Law 29/1994, of 24 November, on Urban Leases: regarding deposits, guarantees, residential leases and other conditions applicable to rental contracts.
· Law 10/2025, of 26 December, regulating customer service: as applicable to the quality, clarity and attention given to consumers and users in the provision of services, as well as to clear, complete and sufficient information in advertising and commercial communications.
Likewise, any other applicable state, regional or sector-specific regulations governing real estate advertising, purchase, lease, pre-contractual information, consumer and user protection, taxation, and the relevant registry, land registry, planning, notarial or administrative documentation for each transaction shall also apply.
3. Advertised price and costs not included
Unless expressly stated otherwise in the specific listing, the published price corresponds to the advertised sale or rental price of the property, not including any taxes, costs, professional fees or other economic items that, legally or contractually, may correspond to each of the parties.
In purchase transactions in Cantabria, the acquisition of a property may involve, among others, the following costs for the buyer:
· Taxes applicable to the transfer, such as the Transfer Tax, VAT or Stamp Duty, depending on whether the property is new build or resale.
· VAT (new build): 10% for homes. 21% generally applies to commercial premises, warehouses and other properties subject to that rate.
· Transfer Tax (resale property): General rate: 9%.
· Primary residence: 7% on the first €300,000 and 9% on the excess.
· Reduced rate of 4% for certain cases (such as buyers under 40, large or single-parent families, and certain persons with disabilities, provided the legal requirements are met).
· Rate of 3% for certain cases of disability equal to or greater than 65%.
· Stamp Duty (AJD): general rate of 1.5%.
· Notary fees: depend on the purchase price and the number of pages of the deed. As a guide, for a property worth €150,000 these may amount to around €700 plus VAT.
· Land Registry registration fees: registration is voluntary, although highly recommended for its legal effects. As a guide, it usually amounts to approximately 70% of the notary fee.
· Administrative agency (gestoría) fees, when mortgage financing is involved; the lender will normally inform of the amount.
· Appraisal fees, in the case of mortgage financing, depend on the surface area and the appraisal company. As a reference, a property of around 150 m² may cost around €500 plus VAT.
· Financial or banking costs arising from the mortgage, where applicable, are set by the lending institution.
· Real estate intermediation professional fees, when chargeable to the buyer and previously informed of and accepted, are those indicated in the advertisement or in the corresponding engagement agreement.
· Any other cost inherent to the formalisation of the transaction by agreement between the parties.
The specific amounts of these items may vary depending on the final purchase price, the applicable autonomous community, the buyer's personal or tax situation, the type of property, the existence or absence of mortgage financing, the chosen bank, available documentation, the appraisal, the land registry reference, the registry status, and any other legal, tax or administrative circumstance that may be relevant.
4. Real estate intermediation fees
In transactions involving the lease of a primary residence, current regulations shall apply, particularly regarding property management costs and contract formalisation costs, which must be borne by the party legally responsible for them.
Under no circumstances shall professional fees be understood to be included in or excluded from the advertised price unless expressly stated.
5. Information on taxes and formalisation costs
Information relating to taxes, notary, registry and administrative agency costs, financing, appraisal or other associated costs is provided for guidance purposes, in accordance with the information available at the time the listing is published.
6. Information on rentals
In rental listings, ACTIVA NORTE GESTIÓN INMOBILIARIA will endeavour to clearly inform about:
· Monthly rent.
· Legal deposit.
· Additional guarantees, if any.
· Community fees, utilities or other chargeable items, where applicable.
· Essential economic conditions of the contract.
· Fees or management costs, where legally required.
· Additional information in the case of a property located in a stressed residential market area, if applicable.
In the case of properties located in areas declared as stressed residential market areas, the information required by current regulations will be included, where applicable, referring to the price index system, previous rent, the landlord's status as a large-scale landlord, and any other legally required circumstances.
7. Information on surface area, characteristics and property documentation
Information relating to surface area, layout, condition, annexes, garages, storage rooms, photographs, floor plans, energy performance certificate, utilities, community fees, planning status, encumbrances, ownership, land registry reference or any other descriptive data of the property is provided in accordance with the available documentation and the information provided by the property owner. ACTIVA NORTE GESTIÓN INMOBILIARIA will endeavour to ensure that the published information is correct, complete and up to date. However, such data may be subject to subsequent verification through registry, land registry, planning, technical, administrative, tax or contractual documentation.
It is particularly important to correctly state the surface area of the property, distinguish, where applicable, between usable and built surface area, and separate annexes such as garages, storage rooms or other elements linked to the property, in order to avoid any incomplete or confusing information that could be misleading, as well as to separate the square metres of common areas.
8. Informational nature of the listings
The publication of a property on this website does not in itself constitute a binding contractual offer, unless expressly stated as such and all legally required conditions are met.
The prices, costs, taxes, fees, surface areas, characteristics, availability and other published conditions may be subject to changes, updates, unintentional errors, price changes, changes in property availability, or variations arising from the final documentation of the transaction.
The final information shall be that resulting from the corresponding contractual, registry, land registry, planning, administrative, technical, financial, notarial and tax documentation, as well as from the agreements expressly entered into by the parties.
9. Consumers' right to information
Consumers and users have the right to request additional information about the property, its sale or rental conditions, associated costs, applicable taxes, professional fees, available documentation and any other relevant matter before formalising a reservation, an earnest money agreement, a purchase contract, a lease contract or any other legal commitment.
